Terms of Service

Plain English terms for sellers and customers using Carto. No legal jargon where we can avoid it.
Who these terms apply to
- •These Terms of Service govern your use of Carto (carto.co.in), operated by Akhil Bavisetti, India.
- •By creating an account, joining the waitlist, placing an order on a Carto-powered shop, or using any part of the platform, you agree to these terms.
- •If you are using Carto on behalf of a business, you represent that you have authority to bind that business to these terms.
- •You must be at least 18 years old to create a seller account.
The Carto service
- •Carto provides Indian Instagram sellers with an online storefront, order management system, and inventory tools accessible via a unique shop link (e.g. carto.co.in/shop/yourname).
- •Carto is a platform — we connect sellers and their customers. We are not a party to any transaction between a seller and their customer, and we are not responsible for the products sold, their quality, or their delivery.
- •The free plan is available indefinitely for eligible sellers. Features, limits, and pricing of paid plans may change with notice.
- •We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will give reasonable notice before material changes that affect active accounts.
Seller accounts
- •You are responsible for keeping your login credentials secure. Do not share your password with anyone.
- •You are responsible for all activity that occurs under your account.
- •You must provide accurate information when creating your account and keep it up to date.
- •One person or business entity may not maintain more than one free account.
- •If you suspect unauthorised access to your account, contact us immediately at hello@carto.co.in.
Seller responsibilities
- •You are solely responsible for the products you list — their accuracy, legality, quality, and safe delivery to customers.
- •You must honour orders placed through your shop. Cancelling orders without reasonable cause, or repeatedly failing to fulfil orders, may result in account suspension.
- •You must not list products that are illegal, counterfeit, hazardous, or that infringe any third-party intellectual property rights.
- •You are responsible for collecting and remitting any applicable GST or other taxes on your sales. Carto does not collect or remit taxes on your behalf.
- •You must not misrepresent your products, pricing, or availability.
Customer orders
- •When a customer places an order on a seller's Carto shop, the contract is between the customer and the seller — not between the customer and Carto.
- •Carto does not process payments. Payment arrangements (UPI, bank transfer, cash on delivery, etc.) are made directly between the seller and their customer.
- •Refunds, returns, and cancellations are governed by the individual seller's policy. Carto has no obligation to resolve disputes between sellers and customers.
- •Customer personal data (name, phone, address) collected at checkout is shared with the relevant seller for order fulfilment only.
Acceptable use
- •You must not use Carto to engage in fraud, deception, or any illegal activity.
- •You must not attempt to reverse-engineer, scrape, or interfere with the platform's infrastructure.
- •You must not use automated tools to create accounts, submit orders, or interact with the platform at scale without our written consent.
- •You must not use Carto to send spam or unsolicited communications to customers.
- •Violation of these rules may result in immediate account termination without refund.
Payments and billing
- •The free plan is free forever with no credit card required.
- •Paid Pro plans are billed in advance on a monthly or annual basis in Indian Rupees (INR).
- •Subscriptions renew automatically unless cancelled before the renewal date.
- •Refunds for paid plans are available within 7 days of payment if you have not used the Pro features. After 7 days, no refunds are issued for the current billing period.
- •We reserve the right to change plan pricing with at least 30 days' notice to active subscribers.
Intellectual property
- •Carto and its underlying software, design, and content are owned by Akhil Bavisetti and protected by applicable Indian and international intellectual property laws.
- •You retain ownership of the content you upload to Carto (product images, descriptions, shop details). By uploading content, you grant Carto a non-exclusive licence to display it as part of providing the service.
- •You must not reproduce, distribute, or create derivative works from Carto's platform or branding without written permission.
Limitation of liability
- •Carto is provided 'as is' without warranties of any kind, express or implied.
- •To the maximum extent permitted by Indian law, Carto's total liability to you for any claim arising out of these terms shall not exceed the amount you paid to Carto in the three months preceding the claim.
- •Carto is not liable for any indirect, incidental, or consequential damages including loss of revenue, loss of data, or loss of customers arising from your use of the platform.
- •Carto is not liable for the actions or omissions of any seller, including non-fulfilment of orders or misrepresentation of products.
Termination
- •You may close your account at any time by contacting us at hello@carto.co.in. Your shop will be taken offline and your data deleted within 30 days.
- •We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if we are required to do so by law.
- •On termination, your right to use the platform ceases immediately. Provisions that should survive termination (liability, intellectual property, governing law) remain in effect.
Governing law
- •These terms are governed by the laws of India, including the Information Technology Act 2000 and the Consumer Protection Act 2019 where applicable.
- •Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
- •If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
Changes to these terms
- •We may update these terms as Carto evolves. We will notify active account holders by email at least 14 days before material changes take effect.
- •Continued use of Carto after the effective date of updated terms constitutes your acceptance of the new terms.
- •The date at the top of this page reflects the latest revision.
